Woman admits
to using sister’s
ATM card

A Spencer woman will be sentenced next month after she admitted using her sister’s ATM card to make several withdrawals.
Nicole Monaghan-Rhodes, 35, of Circle Avenue, Spencer was indicted last year on 39 felony counts of fraudulently using an electronic access device. The charges allege she used an ATM card that belonged to her sister to get cash and make purchases.
In a plea agreement entered in Roane Circuit Court Monday, all the felony charges were dropped and Rhodes agreed to plead guilty to five misdemeanor counts of obtaining money by false pretenses.
Each of the charges carries a maximum penalty of a year in jail and a $500 fine, but prosecutor Josh Downey agreed to recommend probation.
Monaghan-Rhodes agreed to pay restitution of $3,516.27 to the victim, Annalee Tallman.
Judge Tom Evans set sentencing in the case for April 23.
In an unrelated case, a Spencer man admitted to forging his ex-wife’s name to a plea agreement in magistrate court,
Jokwin R. Schoonover II, 31, of Otto Road pled guilty to uttering and conspiracy after special prosecutor Leslie Maze of Wirt County agreed to the dismissal of two other felony charges.
The charges allege he appeared in magistrate court with Martha Harper and forged the name of Laura Schoonover to pleas to worthless check charges after telling the magistrate Laura Schoonover could not appear because she was being treated for psychological problems, which was untrue.
His ex-wife said she never wrote the checks and was not even aware of the charges until several months after the plea had been entered in her name.
Jokwin Schoonover will face 1-to-10 years for uttering and 1-to-5 for conspiracy when he is sentenced May 29.
